New York City has already enacted a requirement that “automated employment decision tools” be assessed for potential bias, California has proposed revisions to its anti-discrimination regulations that directly address these tools, other states and localities are rapidly moving forward with their own forms of regulation, and OFCCP is reviewing employers’ use of AI tools.

Although different in their specifics, all of these new compliance requirements are aimed at ensuring that the use of AI-enabled and automated tools for selection, promotion and other employment-related purposes does not result in biased outcomes.
